Michael Rosenberg of CSK’s Fort Lauderdale West office obtained an order granting a petition for writ of certiorari and quashing a trial court’s order denying a motion to compel the deposition of the medical center’s billing attorney. At the trial court, Sasha Pandolfo and Billy Kirilloff of CSK’s Tampa office argued that a deposition of a key witness was required where the key witness had submitted only an affidavit in support of its motion for summary judgment. The Fifth District determined the trial court departed from the essential requirements of the law and held that “the effect of the trial court’s order was to eviscerate Petitioner’s ability to present its ‘untimely submittal of claims’ defense.
