Condo Association Summary Judgment

Miami Partner, Alan St. Louis, and Miami Associate, Juan Franco, successfully argued for summary judgment in a case against their client, a condominium association.

Two unit owners sued for breach of contract and breach of fiduciary duty claiming the association failed to maintain the building roof; thereby, causing leaks to the unit. The court agreed that the evidence showed the claims were time-barred as the plaintiffs waited too long to bring suit under the statue of limitations. Accordingly, summary judgment was granted in favor of the association. The association will be seeking recovery of prevailing party attorney fees.
