Discrimination Claim Against HOA

West Palm Beach Partner Katie Merwin obtained a favorable ruling before the Palm Beach County Commissioners Office of Equal Opportunity.

The Claimant was a member of a homeowners association and filed a charge of discrimination claiming the Association retaliated against him for previously filing an unrelated charge of discrimination. Following its initial administrative investigation, the Palm Beach Office of Equal Opportunity found reasonable cause that the Association engaged in retaliation in violation of Palm Beach County’s Fair Housing Ordinance.

This investigation allowed the Claimant to seek a final hearing on his petition and seek monetary and equitable relief before the Palm Beach County Commissioners Office of Equal Opportunity. Following a three-day hearing, the Commissioners found in favor of the Association.

They issued a Recommended Order in favor of the Association, concluding it did not engage in unlawful retaliation.
